Mediation in Action


A woman fell and broke her ankle at a golf course out of state. She was planning to sue in her home state. The injury was significant but there were issues of where the lawsuit could be filed and whether there would be problems establishing the ability to sue the golf course in the injured woman’s home state. The injured woman did not want to have to return what could be multiple times to another state for a lawsuit. The golf course did not want to hire an attorney far from its location to defend this lawsuit. The parties decided to use pre-suit mediation to try and resolve the dispute. It was successful. The injured woman had the lawyer of her choice represent her in her home state and the golf course had its counsel represent it in the injured woman’s home state. The parties met and the case resolved at mediation.
